1. What We Do

RescueMyNotes is a privacy-first conversion service that:

• Converts your Evernote ENEX exports into clean Markdown files
• Processes your notes temporarily (3 days maximum)
• Returns a downloadable ZIP file with your converted notes
• Deletes all your data automatically after 3 days

You own your data. We just help you convert it.

2. Pricing and Payments

We offer one-time payments for lifetime access to your converted notes:

• Manual Upload: $19.95 (one-time payment)
• Automated OAuth Import: $29.95 (one-time payment)

Payment Processing

• All payments are processed securely through Stripe
• We don't store your payment information
• Stripe's privacy policy and terms apply to payment processing

Refund Policy

Full refund if conversion fails. If our service cannot successfully convert your Evernote export, we'll provide a complete refund, no questions asked.

3. Your Responsibilities

By using RescueMyNotes, you confirm that:

• You have the legal right to export and convert the Evernote data you upload
• You own the content or have permission to process it
• You won't misuse our service to process other people's data without permission
• You'll use the service responsibly and in accordance with applicable laws

Acceptable Use

You agree NOT to:

• Upload content you don't have permission to process
• Attempt to hack, disrupt, or abuse our service
• Use our service for illegal purposes
• Share access credentials with others

4. How We Handle Your Data

We process your data temporarily and delete it automatically.

Processing Period

• Your files are processed for conversion only
• Maximum retention: 3 days
• Automatic deletion after 3 days (or sooner if you request)

What We Do With Your Data

• Convert your ENEX files to Markdown
• Store temporarily in encrypted form during processing
• Provide a download link to your converted files
• Delete automatically after 3 days maximum

User-Initiated Deletion

You can request immediate deletion of your data at any time by:

• Sending a request to our support email
• Using the /v1/delete-now API endpoint (if available)

We don't mine, analyze, or sell your personal information.

5. Service Availability and Limitations

Best Effort Service

• We provide the service on a "best effort" basis
• No uptime guarantees or service level agreements (SLAs)
• We may experience occasional downtime for maintenance or updates

Conversion Capabilities

• We support standard Evernote ENEX exports
• Complex formatting may not convert perfectly
• Attachments and media are preserved when possible
• We're constantly improving conversion quality

Service Changes

We reserve the right to:

• Update our conversion algorithms
• Change pricing for new customers (existing purchases honored)
• Modify service features with reasonable notice
• Discontinue the service with 30 days notice

6. Limitations of Liability

Standard SaaS Protections:

What We're Responsible For

• Processing your data securely during the conversion period
• Providing refunds for failed conversions
• Protecting your data with reasonable security measures

What We're NOT Responsible For

• Lost data due to user error or network issues during download
• Conversion imperfections (we'll refund, but can't guarantee perfect results)
• Third-party services (Stripe, AWS, etc. - their terms apply)
• Consequential damages beyond the amount you paid for the service

Maximum Liability

Our total liability to you for any claims related to the service is limited to the amount you paid for the conversion service.

7. Privacy and Data Protection

Your privacy is critical to us. Please review our Privacy Policy for details on:

• What data we collect
• How we use it
• How long we keep it
• Your rights under GDPR and other privacy laws

Key privacy principles:

• 3-day maximum retention for all user data
• Automatic deletion after processing
• No permanent storage of personal information
• Encryption during processing

8. Intellectual Property

Your Content

• You retain all rights to your original Evernote content
• You retain all rights to the converted Markdown files
• We claim no ownership over your notes or data

Our Service

• The RescueMyNotes conversion software and service are our intellectual property
• You may not copy, modify, or reverse engineer our service
• You may use the converted files however you wish

9. Termination

By You

• You can stop using the service at any time
• Request immediate data deletion via support email
• No ongoing obligations after your one-time payment

By Us

We may terminate your access if you:

• Violate these terms
• Abuse the service
• Engage in illegal activity

In case of termination, we'll still delete your data within 3 days maximum.

10. Changes to These Terms

We may update these terms occasionally to:

• Reflect changes in our service
• Comply with legal requirements
• Improve clarity and user protection

We'll notify you of significant changes via:

• Email (if we have your contact information)
• Website notice for 30 days

Continued use of the service after changes constitutes acceptance of the updated terms.

11. Governing Law and Disputes

Governing Law

These terms are governed by the laws of England and Wales, without regard to conflict of law principles.

Dispute Resolution

Before filing any legal action:

2. We'll work in good faith to resolve the issue
3. Most disputes can be resolved through conversation

Jurisdiction

For disputes that can't be resolved informally, both parties agree to the exclusive jurisdiction of the courts of England and Wales.
